Perfecto. Ya tengo todo lo que necesito. El T&C del sitio principal me da la entidad legal (Grupo Itúa, S.A. de C.V.), la jurisdicción (Colima, México) y el tono general. Sin embargo no puedo usar el mismo documento porque cubre servicios completamente diferentes: reservaciones de villas, gift cards, programas de afiliados. El Magazine necesita su propio documento enfocado en suscripciones, contenido digital y pagos recurrentes.

1. Overview
The Bahía Magazine is an editorial publication operated by Grupo Itúa, S.A. de C.V., through its luxury hospitality brand Bahía Residences.
Throughout these Terms, “The Bahía Magazine”, “we”, “us”, and “our” refer to this publication and its operating entity, Grupo Itúa, S.A. de C.V.
By subscribing to, accessing, or reading The Bahía Magazine — whether through a free or paid plan — you agree to be bound by these Terms of Service. If you do not agree, please refrain from subscribing or accessing our content.
2. Publication & Platform
The Bahía Magazine is hosted on Substack, a third-party publishing platform. Your use of Substack is also subject to Substack’s own Terms of Service and Privacy Policy, available at substack.com. Grupo Itúa, S.A. de C.V. is not responsible for Substack’s platform, its availability, or any changes to its features or policies.
3. Subscription Plans
The Bahía Magazine offers three subscription tiers:
Free: Access to weekly editorial content and previews of paid posts.
Paid: Full access to all editorial content, including subscriber-only posts, destination intelligence, and behind-the-brand perspectives published by the Bahía Residences team.
The Signature Tier: All paid benefits, plus a private annual conversation with the Bahía Residences team and early access to new properties, destinations, and membership opportunities.
Subscription features may evolve over time. We reserve the right to adjust the scope of each tier with reasonable notice to subscribers.
4. Billing & Payments
Paid subscriptions are billed on a recurring basis — monthly or annually — depending on the plan selected at the time of subscription.
Payments are processed securely by Substack’s payment infrastructure. Grupo Itúa, S.A. de C.V. does not store payment card details.
All prices are displayed in USD. Currency conversion fees, international transaction charges, or bank fees are the sole responsibility of the subscriber.
Grupo Itúa, S.A. de C.V. is not liable for payment failures, processing errors, or interruptions caused by Substack or third-party payment providers.
5. Cancellations & Refunds
You may cancel your paid subscription at any time through your Substack account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to paid content until that date.
We do not offer refunds for partial billing periods, unused subscription time, or Signature Tier benefits not exercised during the subscription year.

6. Intellectual Property
All content published in The Bahía Magazine — including editorial text, photographs, graphics, branding, and design — is the property of Grupo Itúa, S.A. de C.V. or its licensors and is protected under applicable intellectual property laws.
Subscribers may read and share individual articles for personal, non-commercial purposes, provided that proper attribution to The Bahía Magazine and Bahía Residences is included.
The following are strictly prohibited without prior written authorization:
Reproduction or republication of content in full or in substantial part
Commercial use of any content, images, or editorial materials
Modification, adaptation, or derivative use of our content
Removal or alteration of any copyright, trademark, or attribution notices
7. Editorial Independence & No Professional Advice
The content published in The Bahía Magazine reflects the editorial perspectives of the Bahía Residences team. It is intended for informational and inspirational purposes only.
Nothing published in The Bahía Magazine constitutes legal, financial, tax, or investment advice. Readers are encouraged to consult qualified professionals before making decisions based on any content published here.
8. Referral Program
The Bahía Magazine offers a referral program through which subscribers may earn rewards by inviting others to subscribe. Rewards are issued at our discretion and are subject to availability.
Rewards are non-transferable, have no cash value, and may not be combined with other offers. We reserve the right to modify or discontinue the referral program at any time without prior notice.
Fraudulent referral activity — including the creation of duplicate accounts or manipulation of referral tracking — will result in immediate disqualification and cancellation of all associated rewards.
9. Subscriber Conduct
By subscribing to The Bahía Magazine, you agree to engage with our content and community in a respectful and lawful manner.
The following are not permitted:
Sharing paid subscription access with non-subscribers
Using our content or platform for spam, solicitation, or unauthorized commercial purposes
Impersonating the Bahía Residences team or misrepresenting your affiliation with our brand
We reserve the right to terminate subscriptions where conduct violates these Terms, without refund.
10. Privacy
Your personal information is handled in accordance with the Bahía Residences Privacy Policy, available at bahiaresidences.com/privacy-policy. By subscribing, you consent to the collection and use of your information as described therein.
11. Modifications to These Terms
We may update these Terms of Service at any time. Changes will be effective upon publication. Continued use of your subscription after changes are published constitutes acceptance of the revised Terms.
For material changes, we will make reasonable efforts to notify subscribers directly.
12. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Colima, México. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of México.
